I tend to look at accessibility as an amenity issue. If the building does not provide accessible features the amenity is reduced to a lower level that cannot be justified by a statement by a building surveyor.
If as part of the subdivision building work is required then regulation 116 will require the building to comply with accessibility requirements as well.
