Messer’s Prendergast, Jolly and Phillips attended a meeting at DEWLP on Friday 24 March 2017. Notice for this meeting was extremely short (3 days) and was convened to address the Ministers new “garden area” requirements. This has taken a lot of people by surprise and I suspect will end up like the now well known “5 thousand dollar rule”. In a nut shell the Minister has placed specific additional requirements to those of “site coverage” and “permeability” into planning legislation. This requirement is regardless of whether a structure needs a planning permit or not.

The enforcement of this particular requirement is being touted as being under the control of the RBS. This at this stage is a tenuous position as the current Act/Regulations provide no linkage.
